The Higher Education Loans Board (HELB) was established in 1995 through an Act of Parliament CAP 213A of the laws of Kenya. The mandate of HELB is to source for funds and provide financing (through loans, scholarships and bursaries) to Kenyans pursuing higher education in institutions of higher learning in and outside Kenya as recognized by Commission for University Education (CUE) and/or the Technical, Vocational Education and Training Authority (TVETA), and recover funds loaned to create a National Revolving Fund. HELB is an innovative institution in the education sector whose focus is to leapfrog how Financing higher education is executed in Kenya by amalgamating public and private sector resources in the country.

HELB is seeking to recruit competent, self-driven individuals with an innate dynamism for the position of Senior Legal Officer, Litigation and Prosecutions – Grade 5. The successful candidates to fill the positions will join a highly performing team and should not only be passionate, innovative, and qualified, but also be of integrity, dependable, emotional intelligence, effective interpersonal, communication and leadership skills.

Job Purpose:

Reporting to Head of Legal Services and Corporation Secretary, the job holder will be responsible for formulating, reviewing, managing and monitoring statutory and legal policies and procedures relating to litigation, prosecution and alternative dispute resolution processes for the Board.

Key Duties and Responsibilities:

  1. a) Formulating legal policies, standards, guidelines and procedures on litigation, delegated criminal prosecution and Alternative Dispute Resolution for efficient prosecutions;
  2. b) Strengthening policy and law frameworks for prosecution and litigation for efficient service delivery;
  3. c) Formulating litigation, prosecution and ADR strategies for systematic approach to prosecutions, litigation and ADR;
  4. d) Coordinating investigations and supervising civil investigations for efficient evidence gathering;
  5. e) Coordinating administration and supervision of delegated prosecutorial powers
  6. f) Coordinating instituting and undertaking prosecution of criminal and civil matters;
  7. g) Coordinating delegated prosecutions as donated by the Office of Director of Public Prosecutions for enforcement of sanctions under the Higher Education Loans Board Act, CAP 213A to enhance loan recovery;
  8. h) Monitoring compliance with policies, standards and procedures to avoid sanctions and litigations;
  9. i) Formulating mitigation strategies to contain identified legal risks to forestall possible instituting of criminal or civil cases against the Institutions;
  10. j) Providing statutory interpretation briefs and legal opinions on litigation, prosecution and ADR matters for clarity and ease of implementation;
  11. k) Ensuring adherence to departmental Quality Management System (QMS) for efficient operations and service delivery;
  12. l) Providing legal education and awareness programmes/clinics to staff on relevant legal frameworks for understanding, compliance and containment of misinformation and legal risks;
  13. m) Monitoring compliance to legal, statutory, administrative and regulatory frameworks to minimize legal risks exposure;
  14. n) Managing risks in line with Enterprise Risk Management Framework for efficient risk management for informed decision making;
  15. o) Participating in the implementation of the performance management system enhanced productivity; and
  16. p) Developing the legal universe for structured reference on legal compliance.
  17. q) Managing Litigation/other quasi-judicial processes for efficient dispute resolution;
  18. r) Undertaking Legal Research for alignment of litigation, prosecution and ADR functions to emerging issues;
  19. s) Conducting negotiations as appropriate for amicable understanding and resolution of contentious litigation and prosecution matters;
  20. t) Representing the institution in courts and quasi- judicial bodies to exact business known position and cost management;
  21. u) Preparing written and oral submissions for filing and presentation in court to highlight the key legal principles involved in the case;
  22. v) Monitoring compliance with court decisions to avoid contempt of court proceedings and sanctions;
  23. w) Conducting overall review and implementation of legal policies to keep abreast with emerging issues;
  24. x) Briefing and debriefing external lawyers to provide strategies for management of the cases and cost containment;
  25. y) Carrying out legal surveys on identified subject matters for in- depth analysis and for decision making.
  26. z) Coordinating preparation of legal advisories to various departments for informed decision making;
  • Planning and developing departmental annual budget for structured financial management.
  • Planning and budgeting for the Department’s annual financial requirements;
  • Mentoring and coaching direct reports for succession planning and knowledge management;

Minimum Requirements

a) A holder of Bachelors’ degree in Law or its equivalent from a recognized institution;
b) Master’s Degree in Law or MBA from a recognized institution;

c) Minimum of 8 years’ experience with a minimum of 3 years in supervisory position;

d) Post Graduate Diploma in Law from Kenya School of Law or its equivalent;

e) Advocate of the High Court of Kenya;

f) Valid practicing certificate;

g) Member in good standing of the Law Society of Kenya (LSK); and

h) Member in good standing of the Institute of Certified Secretaries (ICS).
