About CREAW
 
Centre for Rights Education and Awareness (CREAW) is a national feminist women’s rights Non-Governmental Organization (NGO). Our focus has consistently set women and girl’s rights at the centre of everything we do. Our programs have over the years focused on challenging practices that undermine equity, equality, and constitutionalism; promoting women’s participation in decision making; and deepening the ideology and philosophy of women’s empowerment. We also support movement building to advance the agenda for social transformation, besides preventing, mitigating and responding to Violence against Women and Girls (VAWG).
 
Background
 
Violence against women is perhaps the most widespread and socially tolerated human rights violation, cutting across borders, race, class, ethnicity, and religion (UNECA 2012). Gender based violence in Africa, as elsewhere in the world, is a complex issue that has at its root structural inequalities between men and women, young and old. This results in the persistence of power differentials between the sexes. Sexual harassment, like other forms of gender-based violence, has become an epidemic of great proportion across Africa.
 
Sexual harassment amounts to the violation of women’s fundamental rights and freedoms recognised in international and regional human rights instruments. In particular, it undermines the right to sexual and reproductive health of women and constitutes an act of discrimination against women. It often violates rights such as dignity, liberty, security of person and freedom from discrimination. Women who suffer sexual harassment, often do not have the requisite access to sexual and reproductive health services (including psychosocial services) and legal remedies.
 
Purpose of the Consultancy
 
CREAW wishes to hire the services of a qualified consultant to conduct a study to determine how sexual harassment cases have been prosecuted in Kenya and further determine the gaps and challenges faced in prosecuting the cases. The main objective of this study is to inform advocacy work on policy and legal reform while increasing awareness amongst the duty bearers and the public. The study will be conducted in a participatory manner and will involve all actors/ stakeholders including: Government, Non-State Actors; Development partners; NGOs; Citizens to name but a few.
The study findings will be published and disseminated across the country and particularly amongst the actors in the Criminal Justice System.
 
Main Tasks of the Consultancy
 
The Consultant will be required to:
  1. Conduct a study of the how sexual harassment cases have been prosecuted to identify the gaps and challenges in the prosecution of these cases.
Key Deliverables
 
The consultancy will be expected to deliver the following:
  • A comprehensive research report on prosecution of sexual harassment cases while clearly highlighting recommendations to address the challenges and gaps identified.
Required Skills and Experience
 
The Consultant required is expected to have the qualification and experience as follows:
  • At least a Master’s degree preferably in Law, Public Policy, Gender Studies, Development Studies or related Social Sciences.
  • An advocate of the High Court with 10 Years’ Experience in Legal Practice
  • Strong Background in legal research and Analysis
  • Experience in Criminal Law especially prosecution of Sexual harassment
  • Experience or knowledge of working with Kenyan Civil Society, Governments, or development partners
  • Excellent writing, editing, attention to detail and organizational skills (Essential)
  • Fluency in English and Kiswahili. (Essential)
Time-frame
 
The assignment is expected to take a maximum of 15 days, which includes desk-review, preparation, and drafting final report.
 
Administrative Arrangements and Roles
 
The consultant will be responsible for guiding the entire process and all other specific responsibilities as stipulated in the TOR. The Consultant will work closely with the CREAW project team to ensure that high standards are maintained/ observed during the exercise.
